This is what you need to know about fire safety and smoke alarm legislation:
Replacing Existing Smoke Alarms
If your existing smoke alarms are more than 10 years old, it is now mandatory to have them replaced with photoelectric type smoke alarms.
New Home Builds or Substantial Renovations
Dwellings that are newly built or substantially renovated in Queensland must have photoelectric smoke alarms which are hardwired and interconnecting.
Ensuring Your Property is Compliant
Landlords must meet new laws which come into place on 1st January, 2022. Non-compliant properties cannot be rented.

Queensland Government Fire Safety Legislation Timeline For Existing Dwellings
From 1st January, 2017
When replacing smoke alarms:
- They must be of a photoelectric type which complies with Australian Standard (AS 3786-2014)
- Existing smoke alarms manufactured more than 10 years ago must be replaced
- Smoke alarms that do not operate when tested must be replaced immediately
- Existing hardwired smoke alarms that need replacement must be replaced with a hardwired smoke alarm
From 1st January, 2027
Smoke alarms in all dwellings must:
- Be photoelectric (AS 3786-2014) and also not contain an ionisation sensor
- Be less than 1o years old and operate when tested
- Be interconnected with every other smoke alarm in the dwelling so that all activate together
Smoke alarms must be installed on each storey:
- In each bedroom
- In hallways which connect bedrooms and the rest of the dwelling; or if there is no hallway, between the bedrooms and other parts of the storey
- If there are no bedrooms on a storey at least one smoke alarm must be installed in the most likely path of travel to exit the dwelling
- Smoke alarms must be hardwired or powered by a non-removable 10-year battery
Queensland Government Fire Safety Legislation Timeline For New or Substantially Renovated Dwellings
From 1st January, 2017
When replacing smoke alarms:
- They must be of a photoelectric type which complies with Australian Standard (AS 3786-2014) and not also contain an ionisation sensor
- Be hardwired to the mains power supply with a secondary power source
- be interconnected with every other smoke alarm in the dwelling so all activate together
Smoke alarms must be installed on each storey:
- In each bedroom
- In hallways which connect bedrooms and the rest of the dwelling; or if there is no hallway, between the bedrooms and other parts of the storey
- If there are no bedrooms on a storey at least one smoke alarm must be installed in the most likely path of travel to exit the dwelling
- Smoke alarms must be hardwired or powered by a non-removable 10-year battery

Smoke Alarm Information for Landlords and Real Estate Agents
As the Landlord of a rented property, it is your responsibility to ensure fire safety legislation is being met.
New or Renewed Tenancy Agreement
Within 30 days before the start of a tenancy in a domestic dwelling, the landlord must test and clean each smoke alarm in the dwelling.
During a tenancy in a domestic dwelling, each smoke alarm in the dwelling must be tested and cleaned at least once every 12 months.
When To Replace Smoke Alarms
Existing smoke alarms manufactured more than 10 years ago, as well as any smoke alarms that do not operate when tested, must be replaced with photoelectric smoke alarms that comply with Australian Standard 3786–2014.
Requirements for Replacing Smoke Alarms
When it is time for your property’s alarms to be upgraded, those alarms must:
- be photoelectric and comply with Australian Standard 3786-2014
- not also contain an ionisation sensor; and
- be less than 10 years old; and
- operate when tested; and
- be interconnected with every other ‘required’ smoke alarm in the dwelling so all activate together.
